Welcome to Cuyo.
These Terms of Service (“Terms”) govern your access to and use of the Cuyo mobile application, website, digital audio tours, tour bundles, and all related services (collectively, the “Services”) provided by Cuyo (“Cuyo”, “we”, “our”, or “us”).
By accessing or using our Services, you agree to be bound by these Terms. If you do not agree with these Terms, you must not use the Services.
If you are using the Services on behalf of another person or organization, you represent that you have the authority to accept these Terms on their behalf.
Cuyo is a digital platform offering self-guided, location-based audio experiences designed to help users discover cities through immersive storytelling.
Cuyo does not provide guided tours, transportation services, travel agency services, or event organization. All tours are self-guided and are completed independently by the user.
The Services may include, among other features:
• Individual audio tours
• Audio tour bundles
• Walking tours
• Driving tours
• Optional interactive experiences
• Temporary shared tour sessions
• Future features and digital content made available through the Services
You must be at least 13 years old to use the Services.
If you are under the age of majority in your country of residence, you may only use the Services with the permission and supervision of a parent or legal guardian.
By using the Services, you represent and warrant that:
• you meet the applicable minimum age requirements
• you have the legal capacity to enter into these Terms
• all information you provide is accurate and complete; and
• you will comply with all applicable laws and regulations while using the Services
We reserve the right to suspend or terminate access to the Services if we reasonably believe that these requirements are not met.
Certain features of the Services require a user account.
You may create an account using one of the following authentication methods:
• Sign in with Apple
• Sign in with Google
• Email and password
Some features may also be available without creating an account through Guest Mode.
You agree to provide accurate, current, and complete information when creating your account and to keep this information up to date.
You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
You must notify Cuyo immediately if you suspect unauthorized access to your account or any security breach.
We reserve the right to suspend, restrict, or terminate accounts that violate these Terms or are used for fraudulent, abusive, or unlawful purposes.
Cuyo may allow users to access certain features without creating an account.
Guest users may have limited functionality compared to registered users.
Guest sessions may not include access to purchases, synchronized progress, cloud backups, or other account-related features.
Temporary access granted through Guest Mode does not create ownership rights or permanent access to any purchased content.
Cuyo may modify, restrict, or discontinue Guest Mode at any time.
Digital audio tours and tour bundles are offered as digital products through supported app marketplaces.
At the time of publication, purchases are processed exclusively through:
• Apple App Store
• Google Play Store
Cuyo does not directly process payment card information.
Payment processing, billing, refunds, taxes, and payment security are handled by the respective app marketplace under its own terms and policies.
Prices may vary by country, currency, platform, taxes, promotional offers, or future pricing models.
Future Services may include additional purchasing options where permitted by applicable law.
When you purchase or access digital content through Cuyo, you receive a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the purchased content for your personal, private, and non-commercial use.
This license does not transfer ownership of any intellectual property.
Except where expressly permitted by applicable law, you may not:
• copy or reproduce any content
• distribute or resell content
• publicly perform audio content
• modify, adapt, translate, or create derivative works
• reverse engineer or attempt to extract source code
• remove copyright or proprietary notices
• use automated tools to scrape or collect content
• commercially exploit any part of the Services
Any rights not expressly granted remain reserved by Cuyo and its licensors.
Cuyo may offer collections of audio tours as digital bundles.
Unless otherwise stated, each bundle grants access only to the tours specifically included in that bundle at the time of purchase.
Future tours, expansions, premium content, or additional cities are not automatically included unless explicitly stated.
Cuyo may introduce promotional bundles, limited-time offers, or other purchasing options at its sole discretion.
Certain tours may support temporary shared sessions that allow additional participants to experience a tour together.
A shared session grants temporary access solely for the duration of the active session.
Guests do not obtain ownership of the underlying tour.
Shared access automatically ends when:
• the host ends the session
• the session expires
• the tour is completed
• technical limitations require termination; or
• Cuyo otherwise ends the session
Guests may not continue using shared content after the session has ended unless they independently purchase or otherwise lawfully obtain access to the relevant tour.
Shared sessions are intended solely for collaborative participation and must not be used to circumvent purchasing requirements or licensing restrictions.
Cuyo reserves the right to introduce reasonable technical limits regarding the duration, number of participants, or availability of shared sessions.
The Services and all associated materials are protected by copyright, trademark, database rights, trade secret laws, and other applicable intellectual property laws.
This includes, without limitation:
• audio recordings
• narration
• scripts
• written texts
• historical research
• tour structures
• photographs
• graphics
• illustrations
• maps
• icons
• logos
• software
• databases
• source code
• user interface designs
• visual layouts
• branding elements
• documentation
Certain content may be licensed from third-party rights holders and remains the property of its respective owners.
Nothing in these Terms transfers ownership of any intellectual property to you.
Unauthorized use may result in termination of your account and legal action.
You agree to use the Services only for lawful purposes.
You must not:
• violate applicable laws or regulations
• interfere with the operation of the Services
• attempt unauthorized access to systems or accounts
• distribute malware or harmful code
• circumvent technical protections
• use bots or automated systems without authorization
• impersonate another person
• infringe intellectual property rights
• misuse temporary shared sessions
• interfere with other users’ experience
• use the Services in a manner that could damage Cuyo’s reputation or infrastructure
Violation of these provisions may result in immediate suspension or permanent termination of access without prior notice.
Your personal safety is your sole responsibility at all times while using the Services.
Cuyo provides self-guided audio experiences only and does not supervise, monitor, or accompany users during any tour.
You must always remain aware of your surroundings and exercise reasonable care and judgment.
In particular, you agree that you will:
• obey all applicable laws and regulations
• comply with traffic rules and pedestrian signals
• never cross streets without using designated crossings where required
• avoid distractions while navigating
• remain attentive to vehicles, cyclists, construction sites, and other hazards
• respect private property and never enter restricted areas without permission
• follow local signs, warnings, closures, and instructions issued by authorities
• ensure that any children accompanying you are properly supervised
• stop walking or driving whenever necessary to safely interact with the Services
Audio playback, navigation instructions, or other information provided through the Services must never take priority over your own judgment or the actual conditions around you.
If using the Services would be unsafe in a particular situation, you must stop using them immediately until it is safe to continue.
Certain experiences may be designed for use while driving.
When participating in a driving tour, you remain fully responsible for operating your vehicle safely and in accordance with all applicable traffic laws.
You must never:
• interact with the application in a manner prohibited while driving
• rely solely on the Services for navigation
• allow audio instructions to distract you from driving safely
Whenever interaction with the application is required, you should safely stop your vehicle before doing so unless local law expressly permits otherwise.
Cuyo is not responsible for traffic conditions, road closures, accidents, vehicle damage, fines, or other consequences arising from the use of the Services while driving.
Certain features require access to your device’s location.
Location information is used solely to provide location-aware functionality, including navigation, automatic tour progression, and context-specific content.
While an active tour is running, location access may continue in the background where supported by your device and operating system in order to maintain the intended user experience.
Cuyo does not permanently store your continuous location history for completed tours.
Location accuracy depends on numerous external factors, including GPS signal quality, weather conditions, buildings, tunnels, trees, device hardware, and operating system limitations.
Accordingly, location-based functionality may occasionally be inaccurate, delayed, interrupted, or unavailable.
Users remain responsible for independently confirming their location and making safe decisions at all times.
The Services may reference museums, parks, monuments, restaurants, businesses, public spaces, film locations, landmarks, or other points of interest.
Cuyo does not guarantee that any location:
• is open
• remains accessible
• continues to exist
• is free of charge
• is safe to enter
• is suitable for all visitors
• offers uninterrupted public access
Opening hours, admission fees, reservation requirements, accessibility, seasonal closures, temporary events, construction work, weather conditions, governmental restrictions, or other circumstances may affect availability at any time.
Users are responsible for independently verifying opening hours, accessibility, ticket requirements, and local conditions before visiting any location.
Such changes do not constitute a defect of the purchased digital content.
Cuyo strives to provide engaging, accurate, and carefully researched content.
Historical facts are researched from publicly available and reputable sources and are independently written by Cuyo.
Artificial intelligence tools may be used during the creative process for brainstorming, language refinement, or editorial assistance. Final content is reviewed, edited, and curated by Cuyo.
Despite reasonable care, historical information, dates, names, interpretations, or background stories may contain inaccuracies, omissions, or differing scholarly opinions.
The Services are intended for educational and entertainment purposes and should not be relied upon as authoritative historical, legal, scientific, or professional advice.
We aim to provide reliable access to the Services but do not guarantee uninterrupted availability.
The Services may occasionally be unavailable due to:
• maintenance
• software updates
• server failures
• internet outages
• app marketplace issues
• GPS limitations
• third-party service interruptions
• force majeure events
• security incidents
• technical problems beyond our reasonable control
Temporary interruptions do not automatically entitle users to refunds, compensation, or damages except where required by applicable law.
Cuyo continuously develops and improves its Services.
We may, at any time and without prior notice:
• correct errors
• improve performance
• modify user interfaces
• update audio content
• revise routes
• replace locations
• improve navigation
• update historical information
• introduce new features
• discontinue existing features
Tours may evolve over time to reflect changing cities, new research, improved storytelling, safety considerations, or operational requirements.
Such updates generally do not constitute a reduction in the value of previously purchased content.
The Services may integrate with or rely upon third-party providers, including but not limited to:
• Apple
• Supabase
• mapping providers
• authentication providers
• analytics providers
• cloud infrastructure providers
• payment platforms
These third-party services operate under their own terms and privacy policies.
Cuyo is not responsible for the availability, accuracy, security, or practices of third-party services that are outside our reasonable control.
To the fullest extent permitted by applicable law, the Services are provided on an “as is” and “as available” basis.
Cuyo makes no representation or warranty that the Services will:
• operate without interruption
• be error-free
• always be accurate
• meet every user’s expectations
• remain permanently available
• be compatible with every device
• function without internet or GPS limitations
Nothing in these Terms excludes warranties that cannot legally be excluded under applicable consumer protection laws.
Nothing in these Terms excludes or limits liability where such limitation is prohibited by applicable law, including liability for intentional misconduct, gross negligence, fraud, death, personal injury caused by negligence where mandatory law applies, or any other liability that cannot legally be limited.
Subject to the foregoing, Cuyo shall not be liable for indirect, incidental, consequential, exemplary, punitive, or special damages, including loss of profits, revenue, business opportunities, goodwill, or data.
Cuyo shall further not be liable for damages arising from:
• inaccurate GPS positioning
• road closures
• traffic conditions
• weather conditions
• inaccessible locations
• acts of third parties
• user negligence
• interruptions of third-party services
• device malfunctions
• internet connectivity issues
• app marketplace outages
Users remain solely responsible for their own decisions, actions, personal safety, travel planning, and compliance with applicable laws while using the Services.
To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Cuyo, its owner, affiliates, licensors, service providers, contractors, and business partners from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or relating to:
• your use of the Services
• your violation of these Terms
• your violation of applicable laws or regulations
• your infringement of any third-party rights
• your negligent, reckless, or intentional misconduct
• content or information you submit to us
• your misuse of temporary shared sessions or other licensed content
This obligation does not apply to the extent that a claim results from Cuyo’s own intentional misconduct or gross negligence.
We reserve the right to suspend, restrict, or terminate access to all or part of the Services at any time if we reasonably believe that you:
• violate these Terms
• misuse the Services
• infringe intellectual property rights
• interfere with the operation or security of the Services
• attempt unauthorized access to systems
• use automated tools without authorization
• share purchased content in violation of these Terms
• engage in fraudulent, abusive, or unlawful conduct
Where appropriate, we may provide prior notice before taking action. However, immediate suspension or termination may occur where necessary to protect users, our infrastructure, or our legal interests.
Termination does not affect rights or obligations that have already arisen before termination.
Shared Tours are designed to allow users to experience a tour together in real time.
The host remains the primary licensed user.
Guests receive only a temporary, revocable permission to participate in the active session.
Guest access automatically expires when:
• the host ends the session
• the tour concludes
• the session times out
• technical limitations require termination
• Cuyo ends the session
Guests acquire no ownership, permanent access, transferable rights, or continuing license to any shared content.
Attempting to circumvent purchasing requirements through repeated guest participation, automated systems, account sharing, or technical manipulation constitutes a violation of these Terms.
Cuyo may impose technical limits on the duration, number of participants, frequency, or availability of shared sessions at any time.
All copyrights, trademarks, logos, audio recordings, scripts, software, designs, databases, graphics, photographs, and other intellectual property remain the exclusive property of Cuyo or the respective rights holders.
Except as expressly permitted by these Terms or applicable law, users may not:
• record audio tours
• redistribute tour content
• upload Cuyo content to third-party platforms
• remove copyright notices
• extract substantial portions of databases
• train artificial intelligence systems using Cuyo content
• use Cuyo content to create competing products
• reproduce route structures or storylines for commercial purposes
We reserve all rights not expressly granted.
You may voluntarily provide suggestions, ideas, bug reports, feature requests, reviews, or other feedback.
Unless otherwise agreed in writing, you grant Cuyo a worldwide, perpetual, irrevocable, royalty-free, sublicensable license to use, modify, publish, incorporate, and otherwise exploit such feedback without compensation or attribution.
You represent that providing such feedback does not infringe the rights of any third party.
Cuyo may introduce additional Services in the future, including but not limited to:
• new cities
• additional countries
• driving experiences
• walking experiences
• interactive experiences
• augmented reality features
• artificial intelligence features
• social functionality
• push notifications
• achievements
• subscriptions
• memberships
• gift cards
• promotional campaigns
• additional purchasing models
Unless expressly stated otherwise, these Terms shall also apply to future Services.
Some new features may require acceptance of additional terms.
Cuyo shall not be liable for delays or failures resulting from events beyond its reasonable control, including but not limited to:
• natural disasters
• floods
• fires
• pandemics
• governmental actions
• armed conflicts
• terrorism
• strikes
• widespread internet outages
• cyberattacks
• failures of third-party infrastructure
• power outages
• GPS disruptions
• failures of app marketplaces
Performance of affected obligations shall be suspended for the duration of the force majeure event.
Nothing in these Terms limits or excludes any statutory rights that cannot be waived under applicable consumer protection laws.
Where mandatory law grants users rights that differ from these Terms, those mandatory provisions shall prevail.
These Terms shall be governed by the laws of the Federal Republic of Germany, excluding its conflict of law rules and the United Nations Convention on Contracts for the International Sale of Goods (CISG).
If you are a consumer residing in another country, you may additionally benefit from mandatory consumer protection provisions applicable in your country of residence where such protections cannot legally be excluded.
Before initiating legal proceedings, we encourage users to contact us so that we may attempt to resolve disputes amicably.
Nothing in this section limits either party’s right to seek urgent injunctive relief where appropriate.
Where permitted by applicable law, the competent courts at the registered place of business of Cuyo shall have jurisdiction over disputes involving business customers.
Mandatory statutory jurisdiction rules for consumers remain unaffected.
If any provision of these Terms is held to be invalid, unlawful, or unenforceable, the remaining provisions shall continue in full force and effect.
The invalid provision shall, to the extent permitted by law, be replaced by a valid provision that most closely reflects its original purpose and economic intent.
Failure by Cuyo to enforce any provision of these Terms shall not constitute a waiver of that provision or of any other provision.
Any waiver must be made expressly and in writing.
We may revise these Terms from time to time to reflect:
• changes in the law
• new features
• technical developments
• security improvements
• operational requirements
• changes to our business model
Where legally required, we will provide appropriate notice before material changes become effective.
Continued use of the Services after updated Terms become effective constitutes acceptance of the revised Terms.
If you do not agree to the revised Terms, you must discontinue use of the Services.

These Terms constitute the entire agreement between you and Cuyo regarding the use of the Services and supersede all prior oral or written understandings relating to the same subject matter.
Any additional terms presented in connection with specific Services shall supplement these Terms. In the event of a conflict, the additional terms shall prevail with respect to the relevant Service only.
